Terms of Use

Version 1.0 (2026-08-05). These Terms govern use of the search marketing budget allocation model and any report it generates.

1. Illustrative estimates only — no warranties or guarantees

The budget allocation model and any report, chart, benchmark, cost-per-lead figure, timeline or lead volume it produces are illustrative model outputs generated for scenario planning. They are provided "as is" and "as available". To the fullest extent permitted by law, CPT Cyber Palm Tree disclaims all representations, conditions and warranties, express, implied or statutory, including implied warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. No traffic, ranking, lead, cost-per-lead, acquisition-cost, revenue or return outcome is guaranteed or promised.

2. No reliance

You agree not to rely on any output of the model as the basis for any business, budgeting, financial or contractual decision. Outputs are not forecasts, predictions, quotations, media plans, statements of work or professional advice of any kind. You should obtain independent professional advice and conduct your own due diligence before acting.

3. Limitation of liability and liability cap

To the fullest extent permitted by applicable law, the aggregate liability of CPT Cyber Palm Tree and its affiliates, officers, directors, employees, contractors and agents arising out of or relating to the model, the report or these Terms shall not exceed CAD $100. This cap applies in aggregate across all claims, whether in contract, tort (including negligence), statute or otherwise.

4. Exclusion of indirect and consequential damages

In no event will CPT Cyber Palm Tree be liable for any indirect, incidental, special, punitive, exemplary or consequential damages, or for lost profits, lost revenue, lost data, lost business opportunity, wasted expenditure or loss of goodwill, even if advised of the possibility of such damages.

5. Your responsibility for input accuracy

The model output depends entirely on the information you supply, including budget, horizon, stage, priority, cost-per-lead and close-rate values. You are solely responsible for the accuracy, completeness and lawfulness of those inputs. We do not verify them.

6. Third-party data limitations

Industry benchmarks are sourced from third-party published datasets (benchmark set 2026.1, retrieved 2026-01-15). Those datasets are averages across many advertisers and may be incomplete, outdated, inconsistently measured or inapplicable to your business. We do not independently verify third-party data and accept no responsibility for it.

7. Model assumptions

The model applies CPT modelling assumptions, including a maturity curve of up to 24 months applied to organic search performance from a standing start. This is a model design choice used for scenario planning. It is not an industry-standard timeline, not an externally verified fact and not a prediction for any particular website. Model version v1.3.

8. Intellectual-property ownership

The model, its scoring logic, coefficients, methodology, report design and all related materials are the exclusive property of CPT Cyber Palm Tree and are protected by copyright and other intellectual-property laws. No licence is granted other than the limited permitted use described below.

9. Permitted report use

You may use the generated report internally within your organisation for planning and evaluation purposes. You may not resell it, present it as your own work, remove attribution or notices, or use it to build, train or benchmark a competing model or product.

10. No agency or professional-adviser relationship

Generating or receiving a report does not create, vary or amend any client, agency, fiduciary or professional-adviser relationship, and does not create any engagement or service obligation.

11. Signed agreements supersede the report

Any executed proposal, Statement of Work or Master Services Agreement between you and CPT Cyber Palm Tree supersedes the report in full. Any calculator output, automated report, benchmark, projection, presentation or other pre-contract material is illustrative only and does not form part of the Services, Deliverables or performance obligations. Only obligations expressly stated in an executed Statement of Work are binding.

12. Privacy and data retention

Details you submit to generate a report (name, business email, company, website and optional phone) together with your inputs and acceptance record are processed as described in the Privacy Policy and retained for as long as needed for the purposes described there, or as required by law.

13. Record of acceptance

When you generate a report we record the Terms version accepted, the date and time of acceptance, the report ID, the model version, your submitted inputs and the benchmark version and retrieval date. This record evidences the terms on which the report was provided.

14. Governing law and dispute resolution

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. The courts of Ontario have exclusive jurisdiction over any dispute, and you attach to that jurisdiction, subject to any mandatory consumer-protection rights available to you.

15. Changes to these Terms

We may update these Terms. The version applicable to a report is the version identified in that report and recorded at the time of generation.
